K1 Fiancee Visa USA and Fiancee Visa Petition
Fiancée visas allow foreign nationals who are engaged to U.S. citizens to enter America and get married. Upon completion of the fiancée visa interview, the fiancée will receive a K1 visa stamp in their passport. The fiancée will then have up to four months for travel into USA with the K1 visa. The fiancée and U.S. citizen must get married within 90 days of fiancée’s entry into USA. The fiancée can apply for adjustment to become a legal permanent resident soon after the marriage takes place. General Requirements for a K1 fiancée visa petition to the USA:
- The process for getting a K1 visa for fiancée starts by filing a petition for the fiancée.
- The petition for fiancée visa must be filed by a U.S. citizen.
- Both the fiancée and U.S. citizen must be eligible to enter into a lawful marriage in the state of residence of the petitioner.
- The marriage must be legally possible according to the laws of the state in the United States where the marriage will take place.
- The couple must have met in person at least once within two years prior to filing the K1 fiancée visa petition.
- U.S. citizen must file an affidavit of support showing adequate financial support for the fiancée as part of the K-1 fiancée visa petition.
- The marriage must take place within 90 days of admission into the United States.
General Process for a fiancée visa petition:
- Step one: Submit a properly executed I-129F, Fiancée Visa Petition along with all the necessary supporting documents to USCIS.
- Step two: Once the K1 fiancée visa petition is approved, it is forward to the National Visa Center for a background check on the fiancée and then to an American Consulate having jurisdiction over the fiancee’s place of residence. The American Consulate will notify the fiancée of the receipt and provide further instructions on how to apply for the K1 fiancée visa for the USA.
- Step three: Apply for the K1 fiancée visa at the American Consulate abroad.
- Step four: Visa Interview. The fiancée will be interviewed with regards to the application.
- Step five: Upon approval, the foreign national will receive a stamp in the passport and is free to travel to the United States. The visa will indicate that your fiancée has six months to use the visa to enter the United States. Once your fiancée enters the USA, however, the passport will be stamped with a ninety day entry. No extension of time is permitted. You and your fiancée must marry and apply to adjust status within ninety (90) days of entry.
